WHY ALL BUSINESSES NEED TO TAKE IMMEDIATE ACTION

·         Businesses that collect and/or maintain NPI must demonstrate that the business has taken "Reasonable Steps" to comply with FACTA, HIPAA, G-L-B Safeguard Rule and their State Privacy Laws.

·         Virtually all businesses in the USA must be in compliance with the "Red Flag Regulations" no later than November 1, 2008.

·         Businesses that fail to meet "Reasonable Steps" could be subject to Federal and State Fines up to $1 million per occurrence.

·         Businesses that fail to protect NPI could be subject to Class Action Law Suites by their customers, vendors and even their past and/or current employees.

·         Plaintiff Lawyers are now allowed to pay "Finders Fees" to individuals who report a possible data breach.

·         State Attorneys General are authorized to pay a "Finders Fee" under HIPAA to individuals who report organizations that have failed to protect NPI.

·         Many states have passed immigration laws.  Employers that hire illegal workers' knowingly or not could face federal imprisonment and fines.

BUSINESSES SHOULD CREATE A SECURE CULTURE

THE RED FLAG RULE REQUIRES:

·         Appointment of a Privacy Officer.

·         All personnel shall be given a copy of said employers Privacy Policy.

·         All personnel, including part-time, seasonal must attend an Identity Theft Awareness Class.

·         Outgoing e-mails must be encrypted.

·         Authorized users of company computers must have a secure log-in.

·         Computer system and/or web-sites must be "Secure".

·         Businesses must have a written procedure on how to destroy NPI.

·         Organizations must be able to verify one's identity before granting credit.

Our company has developed an Affirmative Defense Response System (ADRS) to help all organizations cope with the potential liabilities associated with these federal laws.  Additionally, our ADRS program will help mitigate potential damages and demonstrate that the business entity has taken "Reasonable Steps" to protect NPI.

We welcome the opportunity to demonstrate to you how our ADRS program works for all businesses.  Mr. Paul Morrison, former State Attorney General of Kansa, Michael Moore – Mississippi, Andy Miller – Virginia, Grant Woods – Arizona, Peg Lautenschlager – Wisconsin, Mike Turpen – Oklahoma, Paul Morrison, Kansas, have endorsed Pre Paid Legal Services, Inc. Affirmative Defense Response System
